Change of Flag and the Shadow Fleet: What Changes for Surveys and Certificates

At a flag transfer the printed expiry date of old certificates cannot be relied upon: each instrument has its own transfer provision and new-Administration documents must be effective when required.

Operational Explanation

The printed date on old certificates does not guarantee validity after a flag change. Prepare the transfer certificate by certificate. A legitimate flag change does not by itself establish shadow-fleet involvement; fraudulent registration, inconsistent identity and falsified documents require checks with competent authorities.

MSC/Circ.1140–MEPC/Circ.424 contains a dedicated recommended procedure for flag transfers. The new flag should establish compliance and consult the previous flag where necessary; the latter should promptly provide deficiencies, non-conformities, related timescales and safety information on request. Scope of Application

Many certificates cease at transfer; transitional validity exists only where expressly provided.

Procedure / How to Complete It

• Confirm ship identity, registry and issuer authority through independent official contacts.
• Prepare a matrix showing cessation, any transition and the effective date of each new certificate.
• Agree report transfer and required verification with the new flag and RO.
• Check class, insurance and applicable trading restrictions separately.

Practical Example

The tonnage certificate has a specific transitional regime in article 10 of the Tonnage Convention. That exception does not automatically extend SOLAS or MARPOL certificates or remove verification required by the new flag.
